- PROFESSIONAL BACKGROUND Kenneth Simoncini has practiced law in California as a Civil Trial Attorney for more than 30 years. He is admitted and appeared before the Supreme Court of California, State Appellate District Courts, U. S. Federal District Courts, 9th Circuit Court of Appeals, and the United States Supreme Court. He has conducted jury trials in all Bay Area County Superior Courts, Sacramento, Central Valley, Orange County and LA County. He has participated in Mediation and Arbitration in State, Federal, and Appellate Court. He is admitted to California, Minnesota and District of Columbia Bars. He is the founding member of Simoncini & Associates in 1994. METHODOLOGY
- Resolution is the primary goal of any dispute. Control of the outcome is between the parties rather than strangers. Closure is the result. To achieve resolution, a combination of methods are available:
- Transformative: Where the parties recognize each other's need to resolve the conflict.
- Facilitative: Where the parties negotiate in good faith to reach an equitable conclusion.
- Evaluative: Where the neutral approaches the dispute by identifying the strength and weaknesses of each side of the dispute forming an opinion.
- A combination of methods may be applied during a session to achieve closure. The process begins with a confidential interview with each parties ultimate decision maker. A written position paper would be prepared by each party in advance of the interview. The format of the mediation would be established collectively. Resolution may be achieved when all parties are committed to the process.
